The following Terms and Conditions are for Commissions provided by kornderia

Commissioning the Artist will indicate acceptance by you of all the following Terms of Service, including changes or modifications of such terms and conditions in the future.

REFUNDS

Full refund will be issued in the event that the Artist must cancel work due to sudden unavailability or emergency.

up to 90% refundcan be issued if the Client cancels the Artist prior to Start of Work. (it will not be a full refund due to respective platforms fees. eg.stripe fees paypal fees)

Refunds, as well as unauthorized chargebacks, are not allowed after Start of Work, or if any of these Terms of Service are breached during any period of the commission.

Refund can be ask to be issued if the artist failed to complete the works within the given time period or the artist failed to comunicate or provide update within 120 days

Disliking the Commission or change of mind are not considered for a refund; this is minimalized by providing drafts and progress photos throughout the Commission process.

DEADLINES AND DELIVERY

The Artist works on a regular turnaround of 60 - 90 days unless stated otherwise in the Commission Agreement.

If the Commission is time-sensitive, a rush fee may be applied, to be defined and agreed upon in the Commission Agreement prior to Start of Work.

COMMERCIAL USES and NDA

NDA +25-50%

Small commercial +50-100%: independent streamer/writers, no merchandise production

Full commercial +200-300%: publisher, brand, merchandise production

Price maybe subject to change upon the project and rights agreement, so the client are subject to inform the artist of how they are planning to do with the commission to create a mutual agreement

Any uses that breach the agreement or did not mentioned in the agreement are subjected to an extra charges later.

REPRODUCTION, COPYRIGHTS and BOOK PRODUCTION

The artist reserves the right to publish the commissioned work in the form of a physical artbook, an art book only, and no other goods, which will be sold at conventions with a credits to the commissioner. (it is a yearly artbook, a collection of works, may or may not published in the future)(please inform the artist before the agreement if the clients wish to be excluded from the book)

The Artist retains all rights to the commission, which includes but is not limited to: Distribution, reproduction, use of the Commission for Artist promotion (e.g. Profiles, Personal Space, Public Space, as defined in the Definitions section herein, etc.); or as it applies to new Terms of Service agreed upon in a "Transfer of Copyright Agreement" as defined in the Client Documents.

The Artist reserves all reproduction rights, including the right to claim statutory copyright, on all works.

The Client may not distribute, reproduce, or otherwise profit from the Commission, beyond the new Terms of Service agreed upon in a Commercial Purpose Commission Agreement as defined in the Definitions section herein.

Distributing any Commission from the Artist to the NFT / AI site community is strictly prohibited.

Additional charges : Maybe applied base on the complexity of the drawing/animation and tight delivery date.

Revision & wip: please take note that some type of my commission does not offer revision (Commercial use always includes revision and progress)

I'll only accept characters with proper references. At least a colour headshot will do. Otherwise, it'll count as a Design commission with additional fees.
